A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the enforcement of the requirements regarding plugging |
|
|
of inactive oil or gas wells. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 89.022, Natural Resources Code, is |
|
|
amended by amending Subsection (c) and adding Subsection (d) to |
|
|
read as follows: |
|
|
(c) The commission may refuse to renew or approve the |
|
|
organization report required by Section 91.142 for an operator that |
|
|
fails to comply with the requirements of this subchapter or may |
|
|
enforce those requirements in the manner provided by Subchapter E. |
|
|
(d) Notwithstanding Subsection (c), the commission may not |
|
|
renew or approve the organization report required by Section 91.142 |
|
|
for an operator that fails to comply with the requirements of |
|
|
Section 89.029(a) [this subchapter]. |
|
|
SECTION 2. The changes in law made by this Act apply only to |
|
|
the renewal or approval of an organization report on or after the |
|
|
effective date of this Act. The renewal or approval of an |
|
|
organization report before the effective date of this Act is |
|
|
governed by the law as it existed immediately before the effective |
|
|
date of this Act, and that law is continued in effect for that |
|
|
purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
