A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a study by the comptroller of public accounts of the |
|
|
economic impact of the Texas-Mexico border wall in the State of |
|
|
Texas. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. (a) The comptroller of public accounts shall |
|
|
study the economic impact of the installation of the border wall |
|
|
near the Texas-Mexico border on this state, on local governments, |
|
|
and on businesses, families, and individuals. |
|
|
(b) In completing the study under this section, the |
|
|
comptroller of public accounts shall: |
|
|
(1) focus on the effects of the installation of the |
|
|
wall on those businesses, families, and individuals who own land or |
|
|
operate on land that falls between the international boundary and |
|
|
the border wall; and |
|
|
(2) analyze each parcel of land that falls between the |
|
|
international boundary and the border wall and each business that |
|
|
operates on such land. |
|
|
(c) At the request of the comptroller of public accounts, a |
|
|
state agency or local government shall provide information and |
|
|
assistance in conducting the study under this section. |
|
|
(d) The comptroller of public accounts shall provide |
|
|
updates on the progress of the study required by this section as |
|
|
requested at interim committee hearings conducted by the House |
|
|
Committee on Border and Intergovernmental Affairs and the Senate |
|
|
Committee on International Relations and Trade. |
|
|
(e) Not later than December 1, 2012, the comptroller of |
|
|
public accounts shall report the results of the study conducted |
|
|
under this section to the lieutenant governor, the speaker of the |
|
|
house of representatives, and the presiding officers of the House |
|
|
Committee on Border and Intergovernmental Affairs and the Senate |
|
|
Committee on International Relations and Trade. |
|
|
SECTION 2. If there is no appropriation for conducting the |
|
|
study under Section 1 of this Act, or if an appropriation for |
|
|
conducting the study is insufficient, the comptroller of public |
|
|
accounts shall: |
|
|
(1) make reasonable efforts to seek gifts, grants, and |
|
|
donations to fund the study; and |
|
|
(2) not later than the 90th day following the |
|
|
effective date of this Act and every additional 90 days thereafter |
|
|
until the date the study begins, report to the legislature on the |
|
|
progress of efforts to obtain gifts, grants, and donations under |
|
|
Subdivision (1) of this section. |
|
|
SECTION 3. This Act does not make an appropriation. A |
|
|
provision in this Act that creates a new governmental program, |
|
|
creates a new entitlement, or imposes a new duty on a governmental |
|
|
entity is not mandatory during a fiscal period for which the |
|
|
legislature has not made a specific appropriation to implement the |
|
|
provision. This section does not apply if this Act does not require |
|
|
an appropriation. |
|
|
SECTION 4. This Act expires January 1, 2013. |
|
|
SECTION 5. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
