A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to inspections of flood-prone areas by political |
|
|
subdivisions. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter I, Chapter 16, Water Code, is amended |
|
|
by adding Section 16.3151 to read as follows: |
|
|
Sec. 16.3151. RIGHT TO ENTER PROPERTY IN FLOOD-PRONE AREAS. |
|
|
A political subdivision is authorized to enter and inspect property |
|
|
in a flood-prone area at any time to determine if the property is |
|
|
being maintained in compliance with law or with the ordinances, |
|
|
orders, or rules of the political subdivision that enters the |
|
|
property. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
