A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to specifying the precinct in a notice to appear before a |
|
|
magistrate issued to a person arrested for a traffic violation. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subsection (b), Section 543.006, Transportation |
|
|
Code, is amended to read as follows: |
|
|
Sec. 543.006. TIME AND PLACE OF APPEARANCE. (a) The time |
|
|
specified by the arresting officer in the notice to appear must be |
|
|
at least 10 days after the date of arrest unless the person arrested |
|
|
demands an earlier hearing. |
|
|
(b) The place specified by the arresting officer in the |
|
|
notice to appear must be before the magistrate in the precinct where |
|
|
[a magistrate having jurisdiction of the offense who is in the
|
|
|
municipality or county in which] the offense is alleged to have been |
|
|
committed. The magistrate will dismiss the cause and a complaint |
|
|
may not be refiled if the officer fails to comply with this |
|
|
subsection. |

|
SECTION 2. This Act takes effect September 1, 2011. |
