A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the authority of a general-law municipality to annex
  territory receiving water and sewer services from a municipal
  utility district.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 43.033, Local Government Code, is
  amended by adding Subsection (c) to read as follows:
         (c)  Subsection (a)(3) does not apply to a municipality that
  annexes an area that receives water and sewer service from a
  municipal utility district that provides water and sewer service to
  all or part of the municipality.
         SECTION 2.  Section 43.033, Local Government Code, as
  amended by this Act, applies only to an annexation of an area for
  which a municipality institutes proceedings to annex the area on or
  after the effective date of this Act.  The annexation of an area for
  which a municipality institutes annexation proceedings before that
  date is governed by the law in effect immediately before the
  effective date of this Act, and the former law is continued in
  effect for that purpose.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
