CONCURRENT RESOLUTION
         WHEREAS, Jacqueline A. Carrizales alleges that:
               (1)  in 1999, Mrs. Carrizales and her husband, Frank J.
  Carrizales, moved into a rent house in San Antonio, Texas;
               (2)  the small neighborhood's water service was
  provided by Austin Highway Water Supply Company;
               (3)  in January 2010, the San Antonio Water System
  bought Austin Highway Water Supply Company;
               (4)  many times over the years the Carrizaleses'
  drinking water was brown and undrinkable and the Carrizaleses were
  told to boil the water;
               (5)  the Carrizaleses complained about the water
  quality to the Texas Natural Resource Conservation Commission, the
  predecessor to the Texas Commission on Environmental Quality;
               (6)  Mr. Carrizales was a manual laborer and after work
  would consume large quantities of water to rehydrate;
               (7)  Mrs. Carrizales did not drink water;
               (8)  in 2007, Mr. Carrizales began spitting up blood
  and was told he had Helicobacter pylori bacteria and stomach
  cancer;
               (9)  most of Mr. Carrizales's stomach was removed and
  Mr. Carrizales's weight dropped from 200 pounds to 95 pounds;
               (10)  Mr. Carrizales died at the age of 47 with no prior
  illnesses; and
               (11)  Mrs. Carrizales holds the San Antonio Water
  System responsible for Mr. Carrizales's death because of the poor
  quality of the drinking water; now, therefore, be it
         RESOLVED by the Legislature of the State of Texas, That
  Jacqueline A. Carrizales is granted permission to sue the San
  Antonio Water System for wrongful death and survival causes of
  action related to or arising from the allegations set forth in this
  resolution, in the manner described for a suit against the state
  under Chapter 107, Civil Practice and Remedies Code; and, be it
  further
         RESOLVED, That if Jacqueline A. Carrizales is successful in
  proving her allegations against the San Antonio Water System, Mrs.
  Carrizales is entitled to an award of damages and reasonable
  attorney's fees, prejudgment interest, and court costs authorized
  by law; and, be it further
         RESOLVED, That the president of the San Antonio Water System
  be served process.
