SENATE RESOLUTION
|
|
BE IT RESOLVED by the Senate of the State of Texas, 82nd |
|
Legislature, Regular Session, 2011, That Senate Rule 12.03 be |
|
suspended in part as provided by Senate Rule 12.08 to enable the |
|
conference committee appointed to resolve the differences on |
|
House Bill 2694 (continuation and functions of the Texas |
|
Commission on Environmental Quality), to consider and take |
|
action on the following matter: |
|
Senate Rule 12.03(1) is suspended to permit the committee |
|
to change text not in disagreement in proposed Section 6.03 of |
|
the bill, in amended Section 5.701(n)(1), Water Code, to read as |
|
follows: |
|
(1) Each provider of potable water or sewer utility |
|
service shall collect a regulatory assessment from each retail |
|
customer as follows: |
|
(A) A public utility as defined in Section |
|
13.002 [of this code] shall collect from each retail customer a |
|
regulatory assessment equal to one percent of the charge for |
|
retail water or sewer service. |
|
(B) A water supply or sewer service |
|
corporation as defined in Section 13.002 [of this code] shall |
|
collect from each retail customer a regulatory assessment equal |
|
to one-half of one percent of the charge for retail water or sewer |
|
service. |
|
(C) A district as defined in Section 49.001 |
|
[of this code] that provides potable water or sewer utility |
|
service to retail customers shall collect from each retail |
|
customer a regulatory assessment equal to one-half of one percent |
|
of the charge for retail water or sewer service. |
|
Explanation: This change is necessary to remove a change |
|
to the regulatory assessment collected by certain water supply or |
|
sewer service corporations. |
