FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

March 2, 2011

TO:
Honorable Byron Cook, Chair, House Committee on State Affairs

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB76 by Flynn (Relating to certain purchases by a state agency performing a law enforcement function.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to provide an exemption for agencies with law enforcement functions from certain purchasing procedures if it is determined those procedures would negatively impact homeland security or the agency’s law enforcement functions. The Department of Public Safety, Alcoholic Beverage Commission, Department of Criminal Justice, and Parks and Wildlife Department have determined that the bill would not result in a significant fiscal impact to the State. The bill would take effect immediately upon receiving a two-thirds majority vote in each house. Otherwise, the bill would take effect September 1, 2011.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
