No fiscal implication to the State is anticipated.

The bill would amend the Utilities Code to require a county or district attorney to notify the board of directors of the Texas Underground Facility Notification Corporation of a decision not to bring a civil action against an excavator that violates Section 251.2011.

The bill would amend Chapter 251 of the Utilities Code to specify that this chapter does not supersede, limit, or otherwise interfere with the authority of the Railroad Commission of Texas to impose or enforce a penalty against a person who violates damage prevention safety standards that relate to excavating in the vicinity of a pipeline.
