FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION
Revision 2

March 17, 2011

TO:
Honorable Brandon Creighton, Chair, House Committee on State Sovereignty, Select

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB297 by Berman (Relating to certain federal health care legislation; imposing penalties.), As Introduced

There are anticipated costs and savings associated with the provisions of the bill but there is not sufficient information available at this time to estimate those fiscal implications.

The bill would add a chapter to Subtitle Z, Title 3 of the Government Code to make enforcing or attempting to enforce the federal Patient Protection and Affordable Care Act (ACA), as amended, a class A misdemeanor for public officers or employees of the state.  If enacted, the bill would take effect immediately if it receives a vote of two-thirds of all members in each house, or on September 1, 2011 if not.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
