LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 21, 2011

TO:
Honorable Troy Fraser, Chair, Senate Committee on Natural Resources

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB444 by Creighton (Relating to notification of applications for permits for certain injection wells.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would require the executive director of the Texas Commission on Environmental Quality to submit a copy of an application for a permit for an injection well disposing of industrial and municipal waste to the governing body of a Groundwater Conservation District (GCD) if that well is to be located in the territory of the GCD. The bill also provides that, before testimony is heard in a contested case hearing regarding these wells, the record of the proceeding would be required to include evidence that the executive director of the TCEQ provided a copy of each draft permit to the governing body of the GCD and that notice of the hearing was mailed to the governing body of the GCD.

Although the bill would require the TCEQ to amend current rules and revise some forms and operating procedures, no significant fiscal impact to the state as a result of the bill's passage.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
