LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 4, 2011

TO:
Honorable Dan Branch, Chair, House Committee on Higher Education

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB587 by Kleinschmidt (Relating to eliminating the set-aside of a portion of designated tuition for student financial assistance at public institutions of higher education.), As Introduced

No fiscal implication to the State is anticipated.

The bill eliminates the set-aside of a portion of designated tuition for student financial assistance at public institutions of higher education. The bill also amends Section 56.465 of the Education Code (Tuition set aside for Texas B-On-Time Program) to remove the reference to Section 56.011 which is repealed by the bill.  The requirement for a 5% set-aside on resident undergraduate tuition charged above $46 per SCH for the Texas B-On-Time program would still be in effect. The repeal of Subchapter B of Chapter 56 of the Education Code applies beginning with tuition charged for the 2011 fall semester. Since the bill only impacts the use of institutional funds (designated tuition), there would be no impact to the State.

Local Government Impact

No fiscal implication to units of local government is anticipated.
