LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 12, 2011

TO:
Honorable Sid Miller, Chair, House Committee on Homeland Security & Public Safety

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB633 by Chisum (Relating to certain nonrefundable application fees established by the Commission on Law Enforcement Officer Standards and Education.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code by allowing the Commission on Law Enforcement Officers Standards to refund an application fee if the Commission finds the application was submitted by mistake, even if the application fee is otherwise non-refundable. The Commission indicates that the bill would not result in a significant fiscal impact to the State.

Local Government Impact

The bill would allow the commission to refund application fees for administration of Section 1701.154, Occupations code if an application were determined to be submitted by mistake.

Refunds would constitute a net savings to local law enforcement that would vary by locality depending on the number of applications submitted by mistake and the cost of submitting an application; however, the fiscal impact is not anticipated to be significant.
