LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 18, 2011

TO:
Honorable Lois W. Kolkhorst, Chair, House Committee on Public Health

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB637 by Eiland (Relating to certain treatment by a physical therapist.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code relating to certain treatment performed by a physical therapist.  The bill would clarify the ability of a physical therapist to treat patients, without a referral, within their scope of practice.  The bill would outline certain situations when a physical therapist is allowed to provide treatment and define guidelines for a physical therapist to follow after treatment occurs.  The bill would also amend when disciplinary actions can be imposed due to a physical therapist acting outside their scope of practice.

Based on the analysis of the Executive Council of Physical Therapy and Occupational Therapy Examiners, the bill would cause an increase in licensing and enforcement functions.  Based on information provided by the agency, this analysis assumes that duties and responsibilities associated with the provisions of the bill could be accomplished by utilizing existing resources.

This bill would take effect September 1, 2011.

Local Government Impact

No fiscal implication to units of local government is anticipated.
