LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 12, 2011

TO:
Honorable Sid Miller, Chair, House Committee on Homeland Security & Public Safety

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB647 by King, Phil (Relating to the public safety director's appointment of reserve law enforcement officers for the Department of Public Safety.  ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to allow the director of the Department of Public Safety (DPS) to appoint reserve law enforcement officers. The bill contains provisions detailing the qualifications and duties of reserve law enforcement officers. The bill would also require reserve law enforcement officers to execute and file a bond of $2,000 with DPS. The bill would take effect September 1, 2011. The Comptroller of Public Accounts (CPA) indicates the impact of the provision regarding the bond cannot be determined because it is unknown how many reserve law enforcement officers will be appointed. However, this analysis assumes the impact will be insignificant to the state. This analysis also assumes DPS could implement the provisions of the bill within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
