No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to require a hospital that provides mastectomy surgery, lymph node dissection, or lumpectomy to inform patients of reconstructive surgery options, including available insurance coverage, in writing and before obtaining consent for surgical procedures.

The bill would require the Health and Human Services Commission (HHSC), on behalf of the Department of State Health Services, to adopt rules prescribing the form and contents of the information. It is assumed that any costs associated with rule-making could be absorbed within existing resources.


Local Government Impact

The fiscal impact to a hospital associated with the provisions of the bill would vary depending on the notification procedures currently in place; however, no significant fiscal impact is anticipated.
