The bill would amend the Code of Criminal Procedure relating to the authority of the attorney representing the state to dismiss a criminal action based on the commission of a nonviolent offense. The bill concerns the ability of a prosecuting attorney to seek a dismissal of a criminal action. To the extent the bill would amend court procedures, no significant increase in judicial workloads or fiscal implication to the State is anticipated. The bill would take immediate effect if the bill receives two-thirds the vote of all members. Otherwise, the bill would take effect September 1, 2011.
