FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

February 23, 2011

TO:
Honorable Rene Oliveira, Chair, House Committee on Land & Resource Management

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB745 by Johnson (Relating to requirements for providing documents and written information to certain owners of property subject to the exercise of eminent domain authority.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 21.0112 of the Property Code to require that entities, including governmental entities, that are exercising eminent domain authority provide to certain owners of condemned property documents and written information printed in English, Spanish, or any other language required by the property owner. The change in statute would apply only to a condemnation in which the final offer is made by a governmental entity on or after the effective date of the provisions of the bill.

Local Government Impact

No significant fiscal implication to units of local government is anticipated. There would be costs associated with a local entity offering all required documents and written information in an alternate language, depending on the number of instances in which an alternate language is required.
