No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to reduce the amount of damages in a suit to recover the cost of curing a construction defect by 10 percent for each anniversary of the date of substantial completion of the construction or repair that occurs before the date the suit is filed. To the extent the bill would result in increased filings in the court system, no significant fiscal implication to the state courts or the state is anticipated. The bill would take immediate effect if the bill receives two-thirds the vote of all members in both houses. Otherwise, the bill would take effect September 1, 2011.
