LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

May 6, 2011

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB1028 by Phillips (Relating to certain contact between a criminal defendant and the victim of the offense of which the defendant is convicted or a member of the victim's family.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure and the Government Code to permit a convicting court to prohibit a confined defendant from contacting the crime victim or the victim's family members. The bill would also permit a parole panel to consider in release decisions whether the offender contacted the victim if such contact violated a Department of Criminal Justice policy or a court order.  The Texas Department of Criminal Justice and the Board of Pardons and Paroles have determined that the cost of implementing the provisions of this bill would not be significant.   The bill would take effect September 1, 2011.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
