LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

March 14, 2011

TO:
Honorable Larry Phillips, Chair, House Committee on Transportation

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB1047 by Schwertner (Relating to the impoundment of a motor vehicle if operated without financial responsibility and a driver's license.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to authorize a peace office to impound a motor vehicle of a person that does not provide proof of liability insurance and a driver’s license. The law enforcement agency that impounds a motor vehicle would be allowed to release a motor vehicle to a person that provides proper proof of financial responsibility and payment for the cost of impoundment.

The Texas Department of Public Safety reported there would be costs to create a new form for use by peace officers who impound vehicles and for training; however, the fiscal impact is not anticipated to be significant.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
