No fiscal implication to the State is anticipated.

The bill would add Chapter 109 to Subtitle A, Title 4 of the Local Government Code to authorize a municipality in a county with a population of more than one million to impose a fee not to exceed $5 for records management and preservation services performed by a municipal clerk for a historical municipal document requested from the office of the clerk. The governing body of the municipality would be required to set the fee and determine the documents that qualify as historical. The fee may be used only by the municipal clerk for specific records management and preservation of municipal records.

Local Government Impact

There would be a positive fiscal impact to an applicable municipality that imposes a records management and preservation fee, but the amounts would vary depending on the amount of the fee imposed and the number of qualifying historical documents. It is assumed that applicable municipalities would impose the maximum allowable fee of $5.
