FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

March 25, 2011

TO:
Honorable Joe Deshotel, Chair, House Committee on Business & Industry

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB1162 by Bonnen (Relating to the provision of notice to vacate to certain commercial tenants in an eviction suit.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code and provides that a notice to vacate directed at a tenant who resides in a commercial property may not be affixed to the door of the commercial premise. The notice must be delivered either by person or mail to the tenant who is the subject of the notice to vacate. Then bill could result in new complaints and investigations by the Office of the Attorney General. However, it is anticipated that any additional costs associated with implementation of the legislation could be absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
