LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 29, 2011

TO:
Honorable Tommy Williams, Chair, Senate Committee on Transportation & Homeland Security

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB1353 by Elkins (Relating to speed limits.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code as it relates to speed limits on certain roadways. The bill would authorize the Texas Transportation Commission to establish prima facie speed limits up to 75 miles per hour on parts of the state highway system, eliminate the 65 mile per hour nighttime speed limit, and eliminate the current truck speed limit on Farm-to-Market roads. The bill would require the Texas Department of Transportation (TxDOT) to conceal or remove speed limit signs that do not comply with the provisions of the bill and erect appropriate signs as soon as practicable after the effective date of the bill. The bill would take effect on September 1, 2011. The Department of Public Safety anticipates no significant fiscal impact from the provisions of the bill, and this analysis assumes TxDOT would implement the provisions of the bill within existing appropriations.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
