LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

March 15, 2011

TO:
Honorable Larry Phillips, Chair, House Committee on Transportation

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB1353 by Elkins (Relating to speed limits.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code as it relates to speed limits on certain roadways. The bill would make the prima facie maximum speed limit on portions of the state highway system 75 miles per hour, eliminate the 65 mile per hour nighttime speed limit and eliminate the current truck speed limit on Farm-to-Market roads. The bill would take effect on September 1, 2011. The Department of Public Safety anticipates no significant fiscal impact from the provisions of the bill, and this analysis assumes the Texas Department of Transportation could implement the provisions of the bill within existing appropriations.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
