No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to create a third degree felony for a violation under Section 545.157(b) relating to illegally passing a stationary emergency vehicle if the violation results in serious bodily injury or death.

In fiscal year 2010, less than five people were arrested and placed on misdemeanor community supervision for illegally passing stationary authorized emergency vehicles. For this analysis, it is assumed the number of offenders convicted under this statute would not result in a significant impact to the State.

No significant fiscal implication to units of local government is anticipated.
