HB1743 by Martinez Fischer (Relating to the information provided by a peace officer before requesting a specimen to determine intoxication.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to require an officer to inform a person orally and in writing prior to requesting a person to submit to the taking of a specimen and if the person refuses, the officer may apply for a warrant authorizing the specimen to be taken involuntarily.

The bill would take effect September 1, 2011.

No significant fiscal implication to units of local government is anticipated.
