FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

March 30, 2011

TO:
Honorable Garnet Coleman, Chair, House Committee on County Affairs

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB1767 by Munoz, Jr. (Relating to the enforcement of county subdivision regulations prohibiting more than one residential dwelling on each subdivision lot.), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill would amend the Water Code to authorize a county to adopt a rule to prohibit an owner of a dwelling from building more than one single-family unit on a lot. Violation of the rule would result in a Class C misdemeanor which is punishable by a fine of not more than $500.

Local Government Impact

Costs associated with enforcement and prosecution could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal impact. No significant fiscal implication to units of local government is anticipated.
