Honorable Garnet Coleman, Chair, House Committee on County Affairs
FROM:
John S O'Brien, Director, Legislative Budget Board
IN RE:
HB1769 by Munoz, Jr. (Relating to the enforcement of building code standards for new residential construction in the unincorporated area of a county; providing a fee.), As Introduced
No fiscal implication to the State is anticipated.
The bill would amend the Local Government Code to authorize a county to charge a fee not to exceed $100 for each new residential construction project to defray costs of administering building code requirements.
The bill would repeal Section 233.153(f) and Section 233.157(c) of the Local Government Code.
Local Government Impact
There could be a revenue gain for the new fee and for the Class C misdemeanor that would be imposed for a violation of proper notice for new residential construction, but the amounts would vary depending on the number of new residential construction projects and offenses committed and would be partially offset by the costs of administering the building code requirements.
