LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

May 2, 2011

TO:
Honorable Dan Branch, Chair, House Committee on Higher Education

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB1845 by Castro (Relating to counseling in response to alcoholic beverage violations by students at public and private institutions of higher education.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill requires institutions of higher education to provide at least two counseling sessions to students who violate a state or federal law, local ordinance, or institutional rule involving alcohol.  The bill also amends Section 51.9361(g) of the Education Code to add the counseling requirement as described above to the existing alcoholic beverage statute regarding students. These changes would be effective beginning with the 2011 Fall semester. Several institutions already have similar policies in place. Provisions of the bill would be implemented within existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
