No significant fiscal implication to the State is anticipated.

The bill would require the Texas Commission on Environmental Quality (TCEQ) to require financial assurance as a condition for issuing a registration or permit for the collection, transportation, or processing of grit trap waste or grease trap waste. The bill would also require the TCEQ agency to adopt rules to require additional financial assurance for a commercial solid waste facility, including permittees or registrants who collect, transport, or process grease trap waste or grit trap waste, if the facility treats or processes liquid waste or industrial nonhazardous waste and meets other prescribed conditions. 

Passage of the bill is not expected to result in a significant impact to the TCEQ's workload.


Local Government Impact

Some local governments could benefit from passage of the bill because requiring that certain facilities, permittees, and registrants obtain financial assurance could allow such entities which could otherwise be harmed by a waste hauler’s actions to be reimbursed from the hauler’s financial assurance.
