LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

May 16, 2011

TO:
Honorable Tommy Williams, Chair, Senate Committee on Transportation & Homeland Security

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB2032 by Darby (Relating to performance and payment security for certain comprehensive development agreements.), As Engrossed

No fiscal implication to the State is anticipated.

The bill would amend provisions in the Transportation Code relating to the performance and payment security requirements that must be required of a private entity subject to a comprehensive development agreement between a private entity and the Texas Department of Transportation, a regional tollway authority, or a regional mobility authority.

Based on the analysis of TxDOT, it is assumed the provisions of the bill would not result in a direct fiscal impact to the State.

Local Government Impact

The Alamo Regional Mobility Authority (RMA), the Grayson County RMA and the Cameron County RMA, as well as the North Texas Tollway Authority, reported no anticipated fiscal impact associated with the bill.
