FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 24, 2011

TO:
Honorable Garnet Coleman, Chair, House Committee on County Affairs

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB2348 by Larson (relating to certain standards applicable to certain prisoners confined in a county jail pending transfer to the Texas Department of Criminal Justice.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to remove the authority of the Texas Commission on Jail Standards (TCJS) to adopt a rule that establishes classification requirements and minimum standards for certain prisoners awaiting transfer to a facility operated by or under contract with the Texas Department of Criminal Justice (TDCJ).

The Commission on Jails Standards anticipates costs of approximately $40,000 per year as a result of prolonged inspections anticipated by the provisions of the bill.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
