The bill would amend the Government Code to remove the authority of the Texas Commission on Jail Standards (TCJS) to adopt a rule that establishes classification requirements and minimum standards for certain prisoners awaiting transfer to a facility operated by or under contract with the Texas Department of Criminal Justice (TDCJ).
The bill would authorize a sheriff to establish the classification requirements and minimum housing standards for prisoners that must meet or exceed current standards for inmates imprisoned in a facility operated by or under contract with TDCJ.
The Commission on Jails Standards anticipates costs of approximately $40,000 per year as a result of prolonged inspections anticipated by the provisions of the bill.
No significant fiscal implication to units of local government is anticipated.
The Travis County Sheriff's Office reported the Sheriff's Office currently has procedures that exceed the requirements by TDCJ; therefore, no fiscal impact is anticipated.
The Harris County Sheriff's Office reported the bill would not require changes in current procedures; therefore, no fiscal impact is anticipated.
