Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 7, 2011

TO:
Honorable Jim Jackson, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB2425 by Thompson (Relating to notice to the attorney general of challenges to the constitutionality of Texas statutes.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code and require a notice to the Office of the Attorney General (OAG) of challenges to the constitutionality of Texas Statutes. The bill would also preclude a court from holding a state statute unconstitutional before the 60th day after the notice is served on the OAG. It is anticipated that any additional costs associated with implementation of the legislation could be absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
