No fiscal implication to the State is anticipated.

The bill would add Section 324.104 to the Health and Safety Code to prohibit certain health care facilities from charging a consumer receiving outpatient care at the facility an amount greater than the amount the consumer’s third-party payor pays, computed without any copayment, deductible or coinsurance for the same health care service or supply in an outpatient care setting. The provisions would not apply to a service or supply provided in a hospital emergency room.

Local Government Impact

There could be a fiscal impact to an applicable health care facility that would vary depending on the current amounts charged for outpatient health care services or supplies, the number of outpatient consumers and the types of services or supplies provided.
