LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

May 5, 2011

TO:
Honorable Jerry Madden, Chair, House Committee on Corrections

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB2650 by Allen ( Relating to the establishment of a procedure for imposing intermediate sanctions on a person who violates certain conditions of community supervision.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code and the Code of Criminal Procedure to require criminal court judges to adopt a single system of progressive intermediate sanctions, including increased fines, for violations of conditions of community supervision. The bill would provide direction to community supervision officers who modify an offender's conditions of community supervision to impose a progressive sanction and would require the department to conduct an administrative hearing if the offender objects to the modification. The Department of Criminal Justice anticipates no fiscal impact as a result of the bill.

Local Government Impact

Local governments could be negatively impacted by a potential increase in administrative hearings if offenders object to modified conditions. The bill would provide authority for increasing fines, which could be used to offset the potential cost of increased administrative hearings.
