LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 6, 2011

TO:
Honorable Jerry Madden, Chair, House Committee on Corrections

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB2650 by Allen (Relating to the establishment of a procedure for imposing intermediate sanctions on a person who violates certain conditions of community supervision.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code and the Code of Criminal Procedure to require criminal court judges to adopt a single system of progressive intermediate sanctions for violations of conditions of community supervision. The bill would provide direction to community supervision officers who modify an offender's conditions of community supervision to impose a progressive sanction and would require the department to conduct an administrative hearing if the offender objects to the modification. The Department of Criminal Justice anticipates no fiscal impact as a result of the bill.

Local Government Impact

The bill would amend Article 42.12, Code of Criminal Procedure, so that a defendant who objects to the imposition of an intermediate sanction under the provisions of the bill would be entitled to an administrative review by the community supervision and corrections department supervising the defendant.

According to the Brazos County Community Supervision and Corrections Department (CSCD), the bill would add substantial administrative burden to CSCDs. Brazos County CSCD reported anticipated costs of $105,000 (roughly 3.84 percent of current budget expenditures) per year to hire three new officers due to increased caseload.
