No significant fiscal implication to the State is anticipated.
The bill would amend Section 452.056 of the Transportation Code to limit the liability of employees of certain independent contractors that provide transportation services for or perform functions of Dallas Area Rapid Transit (DART) or the Fort Worth Transportation Authority. The bill provides that those employees would be liable for damages only to the extent that the authority or entity would be liable if the authority or entity itself were performing the function. Current law limits the liability of the independent contractors themselves in the same manner.
The Texas Department of Transportation reported the bill is not anticipated to have a significant fiscal impact on the department.
Local Government Impact
Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
