LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 20, 2011

TO:
Honorable Sid Miller, Chair, House Committee on Homeland Security & Public Safety

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB2756 by Lavender (Relating to the authority of a person who is licensed to carry a handgun to openly carry the handgun.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would strike language related to concealment of handguns from sections of the Penal Code, Alcoholic Beverage Code, Code of Criminal Procedure, Family Code, Government Code, Health and Safety Code, and Parks and Wildlife Code, allowing citizens to openly carry licensed handguns.

This analysis assumes that any costs associated with implementing the bill's provisions could be met with existing resources and that implementing the provisions of the bill would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources of those agencies.

Changes made to the Penal Code would apply only to an offense committed on or after the effective date. The bill would take effect September 1, 2011.

Local Government Impact

No fiscal implication to units of local government is anticipated.
