No significant fiscal implication to the State is anticipated.

The bill would amend provisions in the Transportation Code relating to the authority of the Texas Department of Transportation (TxDOT) to enter into a comprehensive development agreement (CDA) for certain transportation projects. The bill would establish certain requirements for CDA proposals submitted to TxDOT by a private entity. The bill would require environmental clearance for a project to be obtained prior to TxDOT issuing a request for detailed proposals for a CDA. The bill would repeal the expiration dates on TxDOT's authority to enter into a CDA.

Based on the analysis of the Texas Department of Transportation, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within existing resources. It is also assumed any costs associated with entering into a CDA under the authority of the bill would be accommodated through the allocation of the agency's existing highway planning and construction appropriations.
