FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

March 24, 2011

TO:
Honorable Larry Taylor, Chair, House Committee on Elections

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB2959 by Price (Relating to the required transfer of records to a new county chair of a political party; providing a penalty.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Election Code to create a Class B misdemeanor offense if the person formerly serving as the county chair of a political party does not transfer to the new county chair the required documents not later than the 30th day after the new chair’s term begins.

A Class B misdemeanor is punishable by a fine of not more than $2,000, confinement in jail for a term not to exceed 180 days, or both.

Local Government Impact

Costs associated with enforcement, prosecution and confinement could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal implication.
