LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

May 9, 2011

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB2959 by Price (Relating to the required transfer of records to a new county chair of a political party; providing a penalty.), Committee Report 2nd House, Substituted

No fiscal implication to the State is anticipated.

The bill would amend the Election Code to create a Class C misdemeanor offense if the person formerly serving as the county chair of a political party does not transfer to the new county chair the required documents not later than the 30th day after the new chair’s term begins.

A Class C misdemeanor is punishable by a fine of not more than $500.

Local Government Impact

Costs associated with enforcement, prosecution and confinement could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal implication.
