FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 7, 2011

TO:
Honorable Joe Deshotel, Chair, House Committee on Business & Industry

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB3011 by Giddings (Relating to prohibiting the use or retention of zip codes obtained by businesses in verifying the identity of customers; providing a civil penalty.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Business and Commerce Code and prohibit a business from using a customer’s zip code after the purchase of goods. In addition, the Office of the Attorney (OAG) would be authorized to bring an action to recover a civil penalty for violations of the provisions of the bill. The bill may result in new complaints and investigations by the OAG’s Consumer Protection and Public Health Division. However, it is anticipated that any additional costs associated with implementation of the legislation could be absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
