No significant fiscal implication to the State is anticipated.

The bill would require owners and operators of an entity regulated by the Texas Commission on Environmental Quality (TCEQ) to notify the agency no later than one hour (rather than the currently required 24 hours) after discovery of a reportable emissions event. The bill would add a new requirement for emissions to be reported if an emissions event affects an area beyond the site of the regulated entity.  Additionally, the bill would require notification to the TCEQ and any local air pollution control agency in a single report of an emissions event that results in the emission of less than a reportable quantity of air contaminants and affects or is likely to affect as determined by agency rule, an area beyond the site of the regulated entity, including through smoke, odor, measured contaminants, or the deposition of contaminants in the area.  This notification would be required as soon as practicable but not later than one hour after discovery of an emissions event

 

Passage of the bill is not expected to have a significant impact on the TCEQ's workload.
