No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to indicate the entities eligible to analyze DNS specimens submitted by persons who are suspected in criminal investigations. The bill would require law enforcement agencies to seek the expunction of DNA records of certain suspects no longer considered to be suspects. The bill would require the Department of Public Safety (DPS) to ensure certain expunged DNA samples are also expunged from the CODIS database. The bill would take effect September 1, 2011. This analysis assumes DPS could implement the provisions of the bill within existing resources.
