The bill would amend the Code of Criminal Procedure to require a court to consider certain factors when determining whether to grant a request for a reformation of the final judgment and a remittance, and would specify factors that a court may consider when determining the amount of remittance granted for a special bill of review.
The bill would take effect immediately if it receives a vote of two-thirds of all members elected to each house. If the bill does not receive the votes required to pass, the bill would take effect September 1, 2011.
