LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

May 12, 2011

TO:
Honorable Troy Fraser, Chair, Senate Committee on Natural Resources

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB3399 by Legler (Relating to the requirements for grant programs funded through the Texas emissions reduction plan.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would prescribe criteria for the Texas Commission on Environmental Quality (TCEQ) on various procedures relating to the Texas Emissions Reduction Plan (TERP) program. In addition, the bill would prescribe specific guidelines for the implementation of the Texas Clean Fleet Program within TERP, including the reduction of the number of vehicles an entity must operate to participate in the program from 100 to 75.  The bill would require the TCEQ to minimize, to the maximum extent possible, the amount of paperwork required for a TERP application.

Any costs to the TCEQ in implementing the changes proposed by the bill are expected to be absorbed using existing agency resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
