No significant fiscal implication to the State is anticipated.

The bill would amend Subchapter C, Chapter 42 of the Human Resources Code by adding Section 42.04431, which would provide a municipality or county with the ability to enforce state law and rules concerning fire safety standards at a licensed group day-care home or a registered family home.  The bill would also require the municipality or county to report to the Department of Family and Protective Services (DFPS) any observed violation of fire safety standards at such operations.

DFPS indicates it can implement the bill within existing resources.


Local Government Impact

The bill would require municipalities and counties that conduct fire inspections of group day-care or registered family homes to report observed violations of fire safety standards to DFPS. It is assumed that this requirement could be absorbed with existing resources.
