HB3555 by Riddle (Relating to the payment of impact fees by school districts and institutions of higher education.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to include an institution of higher education as a governmental entity that is excluded from certain impact fee requirements. The bill also would exempt a school district or an institution of higher education from a fee imposed under Section 49.212(d) of the Water Code.

The University of Texas System Administration, the University of North Texas System Administration and the Texas A&M University System Administration reported there would be a savings for the institutions, but the amounts are not anticipated to be significant.

The Texas State University System and the Texas Tech University System Administration reported there would be no fiscal impact because the systems currently do not pay impact fees.

The Comptroller of Public Accounts reported there would be no administrative costs to implement the provisions of the bill.


Local Government Impact

There could be a negative fiscal impact to an entity that would no longer collect impact fees, but the amounts would vary depending on the amount of impact fees and current procedures.

The City of Arlington reported no fiscal impact is anticipated since the city does not currently collect fees for construction by institutions of higher education.

The San Antonio River Authority reported there would be a loss of $100,000 in fiscal years 2015 and 2016 from uncollected impact fees, but the amounts would not be significant.
